MUNICIPAL PROSECUTORS AND PUBLIC DEFENDERS
MUNICIPAL PROSECUTORS shall provide all necessary & desirable legal counsel & advice requested for prosecution of cases before the Municipal Court. The Twp currently has Municipal Ct sessions on Wednesday mornings, Wednesday afternoons, Thursday mornings & the first Tuesday of each month.
The CHIEF PROSECUTOR will be the chief legal representative of the State of NJ & the Twp of Cherry Hill in the prosecution of cases before the Municipal Court. The Chief Prosecutor's responsibilities shall include oversight of discovery requests for pending Municipal Court Matters. Additionally the Twp desires to appoint two (2) or more municipal PROSECUTORS for the 2021 calendar year to serve at the direction of the Chief Prosecutor.
PUBLIC DEFENDER shall interview all indigent defendants qualifying for assistance and shall defend those qualified defendants in the Municipal Court of the Twp and provide such legal advice & counsel to such individuals as may be required in any proceedings before the Municipal Court . The Twp currently schedules all defendants represented by a Public Defender for a session on Thursday mornings, however, the Municipal Public Defender and Alternate/Conflict Public Defender(s) may be required to attend Court on other days or times, as needed or as scheduled by the Municipal Court. The Twp will appoint one (1) PUBLIC DEFENDER and one (1) or more ALTERNATE PUBLIC DEFENDERS for the 2021 calendar year.
Due to the present state of the pandemic, it will be necessary to meet with defendants and judge via ZOOM meetings. This would include but not limited to:
Logging into ZOOM and meeting with defendant in “breakout room” to discuss case. Depending on the situation, it may be necessary to postpone and the process will repeat at a later date/time. It will be necessary to meet with the sitting Judge after discussions with defendant to place plea “on record”.
Prosecutor(s) will call witnesses by phone before or after court to discuss before a plea agreement especially in domestic violence cases.
Any other part of the court process that is necessary to complete the assignment.
This process will continue until it has been deemed safe by the Courts to resume court as in the past.
Appointments shall be for the calendar year 2021, price and other factors considered.
